Terms of Use

The relationship between the representative of Smartandplay.com – the company SIA “Smartandplay.com”, registration number in the Latvian Commercial Register 40103883506 – and the buyer is governed by the general terms and conditions prepared by SIA “Smartandplay.com” and the legal acts of the Republic of Latvia.

SIA “Smartandplay.com” prepared terms:

1. The order is placed by the person making a purchase in the online store Smartandplay.com (hereinafter referred to as the Buyer) and a representative of Smartandplay.com, i.e., the company SIA “Smartandplay.com” (hereinafter referred to as the Seller). Placing an order on the website www.smartandplay.com is considered equivalent to entering into a purchase and sale agreement. By visiting the website www.smartandplay.com or using the information provided there about products and services, or by performing any activities on the mentioned website, it will be considered that you personally or the person you represent, if acting on their behalf, have read, agreed to, and will comply with the terms in force at the time of use, as well as our Privacy Policy. Every user of the website is required to regularly review the terms and the Privacy Policy to stay informed of any changes made. In case you do not agree with these terms, the Privacy Policy, or certain definitions contained therein, please do not visit or use the website www.smartandplay.com, or use the services and information offered therein.

1.1. Product

The products “Montessori materials” purchased on the Smartandplay.com website are not children’s toys in the traditional sense. They are educational materials intended for use in children’s education under the supervision of educators, speech therapists, psychologists, and other professionals who apply Maria Montessori’s pedagogy in their daily work.

1.2. Order Placement

The minimum order amount is 10 Euro.

Orders are accepted 24 hours a day. The Buyer places an order electronically by adding items to the virtual shopping cart. The order is finalized when the Buyer selects the “Confirm Order” function.

The Seller sends the Buyer an automatic invoice for the completed order to the email address provided by the Buyer. The invoice is also automatically saved on the Smartandplay.com server, and the Buyer has the option to print it later (by accessing the “My Account” section).

When placing an order, we recommend that the Buyer be very careful when providing personal details and quantities of ordered goods. The Buyer is responsible for the accuracy of their order.

1.3. Order Activation

The order becomes effective from the moment the corresponding payment amount for the purchase is received in the SIA “Smartandplay.com” payment account.

2. Price and Product Payment

Product prices on the www.smartandplay.com website are indicated in Euro (including 21% VAT).

The Buyer pays for the goods according to the invoice prepared by SIA “Smartandplay.com”. The Seller reserves the right to cancel the order and the invoice if the Buyer fails to make the payment within the specified term. The Buyer pays for the goods by transferring the amount to the settlement account of SIA “Smartandplay.com” in the designated bank. Payment for goods may also be made via bank link or, in certain cases, in cash.

3. Product Delivery and Delivery Time

You can find information about the order fulfillment and delivery procedure, as well as the terms for free delivery and additional delivery costs in the section Delivery and Payment.

The delivery time for products in stock is approximately 2 to 4 business days. The delivery time is calculated from the moment the contract is concluded, i.e., when the payment for the purchase is received (see point 1.2.). For products made to order, when the product is not in stock at the time of order, the delivery time is 30 to 90 business days. The Seller reserves the right to extend this term, with prior agreement with the Buyer via phone or email. The Seller is not responsible for the supplier’s decision to no longer deliver a specific product.

If the product is delivered by courier, you will receive an SMS and/or email from the courier company with the delivery date and approximate time window. On the delivery day, the courier representative will call you and inform you of the delivery time. If the Buyer does not answer the call or is not at home, the order will be sent to the courier company’s warehouse for storage, and the Seller will charge an additional fee (usually equivalent to the delivery cost) from the courier company. The Seller has the right to request reimbursement of this fee from the Buyer if it arose due to the Buyer’s fault (as a result of actions or inactions). In Riga, orders are delivered on weekdays from 9:00 AM to 5:00 PM or by prior agreement with the Buyer. The Buyer is responsible for any delivery delays caused by incorrectly or unclearly specified addresses.

The product, with courier delivery, is handed over to the Buyer together with a delivery note, which the Buyer must sign. Before signing, we recommend that the Buyer check the packaging and the quantity of goods. If the packaging or the product has been damaged during transportation, it can be returned to the courier. The product will be replaced with a new, undamaged item in packaging as soon as possible. Claims about packaging and product quantity submitted later will not be considered.

In providing the descriptions of products available on the Smartandplay.com online store, we strive to be as accurate as possible. The range of products and prices may change without prior notice. Manufacturers may alter the specifications of products without prior notice to Smartandplay.com. The product description uses information and images provided by the manufacturer. There may be differences in the form, color, packaging, or design of the product, and the image may include parts that are not part of the product’s package. Product descriptions are for informational purposes, and there may be changes or modifications in parameters or configurations determined by the manufacturer. To clarify or specify the product description and avoid any uncertainties related to its ordering, please contact Smartandplay.com.

In the online store, information about the availability of each product in stock is provided. The online store is equipped with an automated warehouse management system that reduces the stock of products as soon as the Buyer makes the payment for the order. If, at the time of receiving the payment confirmation for your chosen product, the item is no longer in stock and cannot be delivered within the specified time frame, we will contact you and inform you about possible delivery times or offer to cancel the order and refund your money.

4. Product return and order cancellation

The Buyer (a natural person who expresses the wish to purchase, purchases, or may purchase or use a product or service for purposes not related to their economic or professional activity) may exercise the right of withdrawal as provided by the Consumer Rights Protection Law of the Republic of Latvia and return or exchange the received product for another equivalent product within 14 (fourteen) calendar days. The Buyer returns the product after notifying the Seller in advance by email at info@smartandplay.com. The original packaging of the product and the product itself must not be damaged. Otherwise, the product will not be accepted for return.

Return shipping costs in case of product return are covered by the Buyer.

5. Warranty and product return

When selling a product to the Buyer (a natural person who expresses a desire to purchase, purchases, or could purchase or use the product or service for purposes unrelated to their commercial or professional activities), the Seller is responsible for the product’s compliance with the terms of the contract, which is valid for two years after the product is handed over to the buyer. It is assumed that the product’s non-compliance with the contract terms, which manifests itself within six months after the product is handed over to the consumer, existed at the time of delivery, unless this assumption contradicts the nature of the product or defect.

The Seller is not responsible for:

a) for a product damaged by the Buyer;

b) for damages/defects caused by improper use of the product;

c) for damages/defects that occur if the product maintenance is not carried out in accordance with the operating instructions.

If the product does not meet the Buyer’s requirements, the Buyer has the right to request the replacement of the product with one that meets their requirements and is free from defects, or to cancel the order and return the product. In case of return, the transport costs are covered by the Buyer.

The amount paid for the returned goods will be transferred back to the Buyer’s specified bank account within 7 to 14 days from the receipt of the product.

If the Buyer has used the product after identifying a defect, the Buyer’s claims will not be considered.

6. Confidentiality and other terms

The Seller is not entitled to disclose the Buyer’s data to third parties, except as necessary for the reasonable execution of commercial activities (e.g., to a courier company), ensuring that the relevant third parties maintain the confidentiality of personal data and provide adequate protection. The Buyer has the right to request the irreversible deletion of their data from the Seller’s database by notifying via email at info@smartandplay.com.

7. Other terms and conditions

The terms and conditions of Smartandplay.com are the same for all customers. In addition to the general terms and conditions established by SIA “Smartandplay.com,” both parties – the Buyer and the Seller – are protected by the laws of the Republic of Latvia. The rights of the Buyer are protected by the Consumer Rights Protection Center.

Smartandplay.com is not responsible for delays in fulfilling obligations or non-performance, or any other form of non-performance caused by circumstances and obstacles beyond our reasonable control, including but not limited to strikes, government orders, warfare or national emergencies, threats or acts of terrorism, environmental or climate anomalies, non-performance by third parties, internet connection disruptions, as well as computer hardware and software failures. In the case of such force majeure circumstances, we will make efforts to resolve the delays as quickly as possible.

Smartandplay.com has the right to amend and supplement these Terms. The text of these Terms in Latvian is the priority over the translations of these terms in other languages. The changes to these Terms take effect from the moment they are published on the website www.smartandplay.com.

In the event of a conflict between the Buyer and the Seller, we will offer to resolve it through peaceful dialogue. If the parties are unable to reach an agreement, both are entitled to approach the relevant authorities for the evaluation of the situation.

The content and descriptions of products, as well as other information displayed on the website www.smartandplay.com, are the property of SIA “Smartandplay.com”.

It is strictly prohibited to copy, republish, reproduce, distribute, translate, or otherwise use Smartandplay.com materials (texts, images, etc.) without the written consent of SIA Smartandplay.com. If written permission is granted, a reference to Smartandplay.com must be provided alongside the used material.
